Wisconsin OWI With an Illinois License

Last Updated: October 20, 2026

In Wisconsin, a first OWI is a civil forfeiture: a fine of $150 to $300 plus a $435 surcharge, and a revocation of six to nine months, according to the Wisconsin DOT penalty chart. For an Illinois driver, that is only the first half of the case. Once Wisconsin reports the conviction, Illinois revokes the Illinois license for at least one year, and the license stays revoked until the Secretary of State approves reinstatement at a hearing.

Wisconsin calls the offense OWI, operating while intoxicated, and Illinois calls it DUI, but Illinois treats the two the same. The decisions that shape the Illinois outcome are made in the Wisconsin case, and some of Wisconsin’s deadlines run just 10 days from the arrest. Illinois applies the same rules to a DUI from any state, and the full revocation and hearing process is laid out under out-of-state DUI defense in Illinois.

First Offense OWI in Wisconsin: Penalties and Deadlines

The paperwork handed over at a Wisconsin OWI arrest serves as a 30-day temporary license. If a chemical test came back at 0.08 or higher, a six-month administrative suspension starts when that temporary license expires. Under Wis. Stat. § 343.305(8), a driver has 10 days from the notice to request an administrative review, or 13 days excluding weekends and holidays if the notice came by mail.

A refusal runs on its own track. The Wisconsin DOT revokes the operating privilege for one year on a first refusal, starting 30 days after the notice, and a written request for a refusal hearing must reach the court within 10 days. A refusal, or a test result of 0.15 or higher, also brings a one-year ignition interlock requirement in Wisconsin.

A conviction then adds the court-ordered revocation of six to nine months. Wisconsin law limits plea bargaining in OWI cases: under Wis. Stat. § 967.055, a prosecutor who wants to amend or dismiss an OWI charge has to justify it to the court. All of these penalties govern driving in Wisconsin. What happens to the Illinois license is decided separately, by the Illinois Secretary of State.

How a Wisconsin OWI Affects Your Illinois License

Wisconsin is not a member of the Driver License Compact, but it reports OWI convictions to Illinois, and a first conviction means an Illinois revocation of at least one year. Illinois revokes even though Wisconsin does not treat a first offense as a crime. The Wisconsin conviction also counts as a prior DUI under 625 ILCS 5/11-501 if there is ever a second arrest, which raises the minimum Illinois revocation to five years when the two fall within 20 years. A first-time DUI in Illinois can end in court supervision, which avoids a conviction and the revocation that comes with it. Supervision is a disposition only an Illinois court can enter, so a Wisconsin case cannot end that way.

Reporting can take weeks or months, and the Notice of Revocation goes to the address on file with the Illinois Secretary of State. Those notices are not forwarded, and the revocation takes effect whether or not the driver receives it, so anyone who has moved should update their address with the Secretary of State directly.

Wisconsin OWI Refusal Pleas and Your Illinois License

An Illinois driver who resolves the Wisconsin case with a plea to the refusal, rather than to the OWI itself, gets a different result in Illinois. Under 625 ILCS 5/6-203.1, Illinois suspends the driving privileges of a person who refused a chemical test in another state, for the period set by the statutory summary suspension schedule: 12 months for a first offender, and three years for anyone who is not.

That suspension works differently from a revocation. It ends on a set date with the reinstatement fee paid, and no Secretary of State hearing is required to get the license back. A refusal is also not a DUI conviction or supervision, so it does not count against eligibility for supervision if the driver ever faces an Illinois DUI later, under 730 ILCS 5/5-6-1(d).

The refusal carries its own Wisconsin penalties, including the one-year Wisconsin revocation and ignition interlock requirement, and it is only available if the Wisconsin prosecutor agrees to it. Whether it fits a particular case depends on the evidence and on how the driver uses a license day to day.

Once a Wisconsin OWI conviction is entered and reported, the Illinois revocation follows. The options that avoid it, including an acquittal, a dismissal, a reduction to a charge Illinois does not treat as DUI such as reckless driving, or a refusal plea, all have to happen in the Wisconsin case.

Getting Your Illinois License Back After a Wisconsin OWI

When a refusal suspension is followed by a conviction on the OWI for the same incident, 625 ILCS 5/6-203.1(b) credits the time already served on the suspension toward the minimum Illinois revocation.

The Illinois process can also start before the Wisconsin case ends. An alcohol and drug evaluation, along with any recommended treatment or remedial education, can be completed in Illinois while the Wisconsin case is pending, so the driver is ready to request a Secretary of State hearing as soon as the revocation posts. A driver with no prior DUI conviction or statutory summary suspension is usually eligible for an informal hearing at a local Secretary of State facility.

Depending on the case, an Illinois driving permit may carry its own breath alcohol ignition interlock device requirement, separate from Wisconsin’s. Reinstatement also requires proof of SR-22 insurance, which has to be maintained for 36 months, and the reinstatement process covers evaluation levels, treatment hours, and permits in detail. A driver who later moves out of Illinois before reinstating carries the revocation along as a hold that blocks licensing in other states.

Reinstating Your Wisconsin Driving Privileges

Reinstating an Illinois license does not restore the right to drive in Wisconsin. The Wisconsin revocation stays on Wisconsin’s records until the driver completes Wisconsin’s requirements, including the required alcohol and drug assessment and the reinstatement fee. A driver who regains Illinois privileges but skips the Wisconsin steps can still be cited for driving while revoked the next time they cross the border. The conviction itself does not age off: Wisconsin keeps OWI convictions on its driving records for life.

Do You Need a Wisconsin Lawyer, an Illinois Lawyer, or Both?

You need both. A Wisconsin-licensed attorney handles the OWI charge in Wisconsin court, including the administrative review, the refusal hearing, and any plea. An Illinois attorney handles your Illinois license: the revocation or refusal suspension, the evaluation and treatment record, and the Secretary of State hearing. Because the Wisconsin plea decides what Illinois does, bring the Illinois attorney in before that plea is entered.
